Cataluña contra la monarquía Borbónica: La primera Constitución de las Cortes Catalanas 1705-1706

// Resumen // Las Cortes de Barcelona de 1705-1706 tienen una gran importancia por haber sido las últimas de la Cataluña del Antiguo Régimen. La derrota del bando austracista en la Guerra de Sucesión trajo consigo la abolición de las instituciones políticas del Principado y el fin de un Estado que había brillado con luz propia desde la Edad Media. En el presente artículo se estudia la primera Constitución de esta última reunión del monarca con los estamentos de la tierra. También llamada Ley de Exclusión de la Casa de Borbón, en esta Constitución los catalanes consintieron finalmente en la aprobación de una resolución que tenía un significado político sin precedentes. Además, en dicha Constitución aparece por primera vez en un documento de estas características el término Leyes Federales, concepto que ha dado pie a desorbitadas interpretaciones que deben ser matizadas. Remontándonos, pues, a la muerte de Carlos II, intentaremos exponer nuestra lectura de los acontecimientos.

// Abstract // The Courts of Barcelona (1705-1706) had a high importance because they were the last achieved in Catalonia during the Ancient Regime. The defeat of the Austrian faction in the Spanish Succession War brought the abolition of the political institutions of the Principality and the end of a State that had stood out on ones own from the Middle Ages. We study in this article the first Constitution of this last assembly that used to meet the king and the Commons of the land. Also known as Law of Exclusion of the House of Bourbon, the Catalans finally agreed to approve a resolution that had an unprecedented political significance. Moreover, in this Constitution appears firstly in a document of this kind the notion Federal Laws, concept that forced thoughtless explanations that must be qualified. So, starting with the death of Charles II, we are going to try to expose our reading of the events.
